Frequently Asked Questions

These are the real questions clients bring us — answered the way we answer them on the phone: directly, without legal fog.
Bank Account Freeze
Why did the cyber cell freeze my bank account?
Because a transaction traced to your account was reported as cyber fraud proceeds — usually a payment you received from someone who, somewhere upstream, used a victim's money. Banks act on cyber cell instructions under Section 106 of the BNSS (earlier Section 102 CrPC). You can be completely innocent and still get frozen; most frozen account holders are.
How do I unfreeze a bank account frozen by cyber police?
First obtain the freeze details from your bank — freezing authority, notice reference and disputed amount. Then a legal representation with evidence of your genuine transaction is filed with the investigating officer. If the officer does not act, the matter is escalated to the jurisdictional magistrate or High Court. This is our core specialisation — we run this process end to end.
How long does unfreezing take?
With complete documents and correct representation, typically 2–8 weeks. Multi-complaint or inter-state matters take longer. Waiting before acting is the main cause of long timelines — freezes never resolve themselves.
What is a lien on my account and is it better than a full freeze?
A lien blocks only a specific disputed amount; the rest of your balance stays usable. Converting a full freeze into a lien ('lien-narrowing') is often the fastest practical relief — your salary and business banking resume while the disputed amount is examined.
Can the entire account be frozen for a small disputed amount?
It happens routinely, but courts have held such blanket freezes disproportionate — notably the Delhi High Court in Malabar Gold & Diamonds v. Union of India (January 2026), which found freezing a non-accused's account without magistrate oversight violative of Articles 19(1)(g) and 21. We use exactly this jurisprudence in representations.
Online Fraud & Recovery
I lost money in an online scam. Can it be recovered?
Often yes, if you act fast. Reported within 24–48 hours through 1930/NCRP, funds are frequently held mid-transfer in the mule account chain. Held funds are then claimed back through the legal refund process. After weeks, recovery depends on what is still traceable — we assess honestly before you spend anything.
What is the 1930 helpline and when should I call it?
1930 is India's national cyber financial fraud helpline. Call it immediately after any fraudulent transaction — it triggers the interception system that flags beneficiary accounts across the banking network. Follow up with a detailed complaint on cybercrime.gov.in.
My NCRP complaint has shown no progress for months. What can I do?
A complaint is an entry in a queue; movement needs follow-up. We audit what you filed, fix evidentiary gaps with a supplementary representation, pursue the investigating officer in writing, and escalate to FIR or magistrate where justified. Stalled complaints are recoverable.
Are 'money recovery agencies' that contact victims genuine?
Almost never. Guaranteed-recovery agencies demanding upfront fees are a second scam industry targeting victims. Recovery flows only through the banking hold system and legal process. Verify anyone you engage — a real advocate has a Bar Council enrolment you can check.
Blackmail, Hacking & Other Matters
Someone is blackmailing me with a private video. Should I pay?
No — paying marks you as exploitable and demands escalate. Preserve evidence, stop responding, report confidentially, and get legal help the same day. Handled correctly, the vast majority of sextortion matters end without any exposure. Your matter stays completely confidential with us.
My WhatsApp/Instagram was hacked. Is that a police matter or a platform matter?
Both. Platform recovery gets your account back; a cyber complaint creates the legal record, pressures platforms to act faster, and protects you if the hacker defrauds your contacts. Hacking and impersonation are offences under IT Act Sections 66, 66C and 66D.
A loan I never took is on my CIBIL report. Whose problem is it?
Yours until formally corrected — which is why bureau disputes alone rarely work. The sequence that works: cyber complaint for identity theft, legal notice to the lender, then bureau correction backed by that paper trail. We run all three.
Working With Us
Do I need to visit your office, or can everything be handled remotely?
Nearly all cyber matters — freezes, complaints, recovery — are document-driven and handled fully over phone, WhatsApp and email. We represent clients across India from Gujarat, engaging local counsel where a physical court appearance is required. In-person consultations in Ahmedabad are available by appointment.
What does the first consultation cost?
Nothing — the first consultation is free. We hear your matter, tell you honestly where you stand and what is realistically achievable, and quote clearly before any engagement. No pressure, no false promises.
Is my information kept confidential?
Absolutely. Every matter — especially blackmail and personal cases — is handled with strict confidentiality and professional privilege. Discretion is non-negotiable in this practice.
Which languages do you work in?
Hindi, English and Gujarati — consultations in whichever you are comfortable with; documents drafted in the language the forum requires.
Official Government Helplines — use these too
Whether or not you engage a lawyer, report the crime on India’s official channels immediately — reporting fast is what freezes stolen money in the chain.
- 1930 — National Cyber Crime Helpline (financial fraud interception; call within 24–48 hours of the fraud)
- cybercrime.gov.in — National Cyber Crime Reporting Portal (NCRP) for the formal written complaint
- Your district Cyber Cell / police station — for FIR registration in serious matters
Where we come in: making sure what you file is legally precise, following it up until it moves, and running the release/refund process the portals do not do.
